1. Who these terms are between
These Terms of Service ("Terms") are an agreement between you ("you," the account holder, whether an individual or an organization) and CastMaster ("we," "us") governing your use of the CastMaster application, at [DOMAIN], and any related services (together, the "Service").
By creating an account or using the Service, you agree to these Terms. If you're creating an account on behalf of a theatre company, school, production company, or other organization, you're confirming you have the authority to bind that organization to these Terms.
2. What the Service is
CastMaster is production-management software for theatre, film, and commercial productions. Depending on your plan, it lets you manage actors, roles, scenes, casting, blocking and movement, wardrobe/makeup/ décor/lighting references, call sheets, team members and permissions, and related production data ("Production Data").
3. Accounts
- You're responsible for the accuracy of the information you provide and for keeping your login credentials confidential.
- You're responsible for activity that happens under your account, including actions taken by team members you invite.
- You must be at least 16 years old to create an account. If you're using CastMaster on behalf of a school or educational program, the institution is responsible for compliance with any applicable rules about student accounts.
- We may suspend or terminate an account that violates these Terms, that we reasonably believe is being used fraudulently, or where required by law.
4. Production Data you upload
Much of what you put into CastMaster is data about other people — actors, roles, wardrobe notes, photos, contact and scheduling information. You're responsible for having the right to collect, store, and share that data with your own team through CastMaster, including any consent required from the actors or collaborators involved. We process this data on your behalf to provide the Service; we don't claim ownership of it. See our Privacy Policy for how we handle it.
Don't upload data you don't have the right to upload, or use the Service to store information unrelated to running a production.
5. Subscriptions, billing, and plans
- CastMaster offers a free tier and paid tiers (currently Pro and Studio); features and limits for each are shown on the billing page and may change with notice.
- Paid plans are billed in advance for the period selected (monthly or annual) via the payment method(s) we support at the time — currently USDC on-chain payment[, and card payment via Stripe once enabled].
- Payments are non-refundable except where required by law or where we state otherwise. You can cancel or downgrade at any time; access to paid features continues until the end of the period you've already paid for.
- If a payment can't be verified or fails, we may downgrade your account to the free tier.
6. Acceptable use
You agree not to:
- Use the Service to violate any law, or to store or share content you don't have the rights to.
- Attempt to gain unauthorized access to another account, org, or to the Service's infrastructure.
- Interfere with the Service's normal operation (including attempting to bypass rate limits, scraping at scale, or automated account creation).
- Resell or white-label the Service without a separate written agreement with us.
7. Availability
We aim to keep the Service available, but we don't guarantee uninterrupted access. We may perform maintenance, and we'll try to keep planned downtime brief and, where practical, scheduled outside peak hours.
8. Termination
You can stop using the Service and delete your account at any time. We may suspend or terminate access for a material breach of these Terms that isn't fixed after we notify you, or immediately for severe violations (fraud, illegal use, security threats to the Service or other users).
On termination, we'll retain your data for a reasonable period in case you want to export it or reactivate, then delete it in line with our data retention practices — see the Privacy Policy.
9. Disclaimers and limitation of liability
The Service is provided "as is." To the extent permitted by law, we disclaim warranties of any kind, and our liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose. Nothing in these Terms limits liability where the law doesn't allow it to be limited.
10. Changes to these Terms
We may update these Terms as the Service changes. For material changes, we'll make a reasonable effort to notify active accounts (e.g. by email or an in-app notice) before the change takes effect.
11. Governing law & contact
[Set the governing law/jurisdiction here once you know where the business is legally established.] Questions about these Terms: [SUPPORT EMAIL].
